PPMO to investigate procurement contracts

KATHMANDU: The Public Procurement Monitoring Office (PPMO)has started an investigation for tracking whether the same construction company has entered into more than five procurement contracts. Through the 11th amendment of the Public Procurement Regulations, the government has introduced a provision that restricts the same contractor company to get more than five contracts. However, the newly introduced provision could not be implemented properly.  In the absence of a unified data system, the PPMO has been facing difficulties to get information about the number of contracts signed by the contractor companies. As per the new provision, the relevant company will enter the details of the construction company on the online system of the PPMO after the agreement is reached.

 In March 2022, the government introduced the new provision through the 11th amendment of the Public Procurement Regulations to ensure that a construction company participates in the bidding process as a single entity or joint venture.  According to the amendment, it has been arranged that construction entrepreneurs should also self-declare that they have not participated in more than five bidding processes.

For that, a notice has been issued to the public bodies to enter the updated information regarding the procurement contract in the system in the procurement office within 7 days. According to this, by 16th July, all the public bodies have to enter the information related to the contract.

In previous years, the PPMO had requested public bodies to enter details of procurement contracts in the system. However, public bodies did not give priority to keeping the details in the system.

“However, from now on, details must also be entered to know how many contracts have been signed by which bidding companies,” said Krishnaraj Panth, Director of Public Procurement Monitoring Office, Procurement Monitoring Division. In this regard, the method of updating contact details in the system can be obtained from the ‘User Manual’.

According to the Public Procurement Act, 2007 and the Public Procurement Regulations, 2008, the details of all procurement activities with procurement contracts have to be updated in the electronic procurement system operated by the PPMO.

 Three-day deadline

It is mentioned in the notice that in the case of procurement agreements made after the publication of the notice (10 July 2079), it must be entered into the electronic procurement system within 3 days from the date of the procurement agreement.
